Municipal Court Criminal Charges
The grade of criminal offense heard in municipal court is termed disorderly persons or petty disorderly persons offense. Although these violations are what people often refer to as misdemeanors, they nevertheless carry the potential for up to six (6) months in jail, over a thousand dollars in fines, assessments and court fees, and result in a record. Some of the more common criminal offenses heard in municipal court are:
- Possession of Less than 50 Grams of Marijuana
- Drug Paraphernalia
- Disorderly Conduct
- Simple Assault
Traffic Violations. Whenever a motor vehicle violation is issued, the charge is heard in the municipal court of the town where the infraction occurred. There are a wide range of traffic offenses heard in Clifton, Wayne or the other courts within Passaic County including DWI, speeding, driving while suspended and driving without insurance to name a few. It is important to keep in mind, however, that while the court can impose penalties for particular offenses upon conviction, it does not assess motor vehicle points or insurance surcharges. The extent of the court’s involvement is to notify the motor vehicle commission of the outcome of the charge and it is up to the division to decide what, if anything, shall be done administratively.
Municipal Ordinance Summonses. Almost every municipal has a set of local regulations termed ordinances which apply to activities within the town. When someone allegedly violates an ordinance, a summons may be issued. Ordinance offenses are decided in the municipal court of the town where the infraction is alleged to have occurred.
