Little Falls NJ Simple Assault Defense Attorneys: 2C:12-1(a)
The simple assault law, which comes into play in many settings, including a street fight, bar altercation, confrontation with a police man, or even an alleged incident of domestic violence, is contained at N.J.S.A. 2C:12-1(a). An individual can be convicted of simple assault if he or she: (1) attempts to cause bodily injury or put another in imminent fear of serious bodily injury; (2) purposely or recklessly causes bodily injury to another; or (3) negligently causes injury with a deadly weapon. Simple assault is a disorderly persons offense except when it results from a mutual or consensual fight, in which case it is a petty disorderly persons charge. The penalties for simple assault include fines, criminal assessments, up to six (6) months in jail and probation. A plea of guilty or finding of guilt also results in a criminal record. A conviction under 2C:12-1 remains on a person’s record until such time that it is expunged, the application for which cannot be filed for at least five years after completion of probation.
