  • Elements of  an Offense Under N.J.S.A. 2C:12-3. The prosecutor must establish three (3) elements to prove a terroristic threats charge. First, there must have been a threat. Second, the threat must be to commit violence. Third, the state must establish that the threat was made with a purpose to either terrorize or cause the evacuation of a building, or otherwise to cause serious public inconvenience. The third element may also be satisfied alternatively if it is proved that the defendant acted in reckless disregard of the risk of causing terror or inconvenience.
  • Grading of Offense. All terroristic threat charges are venued at the Passaic County Superior Court, Paterson NJ, as they are indictable offenses. Where a terroristic case is venued in Passaic County depends on the grade of the charge involved. Typically, a terroristic threats complaint gives rise to a Third Degree Crime. The offense is, however, elevated to a Second Degree where the violation occurs during a declared period of national, State, or county emergency.
  • Penalties. The jail term term in the event of conviction for making a third degree terroristic threat is zero to five (5) years in prison. A second degree charge carries five (5) to ten (10) years in jail. There is a presumption that a prison term shall be imposed where someone is convicted of second degree terroristic threats. The maximum fine is $15,000 for a third degree and $150,000 for a second degree.
